Huck Finn and Social Justice
Hucà Chenxing Ouyang 3/20/2013 American Lit-Social Justice & Huck Finn ââ¬Å"Persons attempting to find a motive in this narrative will be prosecuted; persons attempting to find a moral in it will be banished; persons attempting to find a plot in it will be shot. â⬠This notice at the beginning is controversial; some people say that it is a warning that was written for readers at the time when slavery was a sensitive issue to talk about, while others interpret it as a satirical comment about the way literature is scrutinized to find means and morals in a book.But I believe what Mark Twain is trying to say is: ââ¬Å"Donââ¬â¢t try to analyze the book, just read it for fun, no pressure! ââ¬Å" In the bookà The Adventures of Huckleberry Finnà by Mark Twain, the lifestyleà of the Southerners in the mid-1800s are depicted through the eyes of a 13 years old boy Huck Finn living along the Mississippi River. It is a book about the search for freedom. Main characters in the movie seek freedom from social and moral constraints. Throughout novel, Huck learns to follow his own morals and values over what society deemed to be acceptable in the 1800 s.He eventually achieved what he desires the most-freedom. In Twainââ¬â¢s opinion, it is the ââ¬Å"closed mindsets about slavery of the society prohibited the development of personal morality and social justice. â⬠à à One of the most important issues presented in this book is slavery. The superiority of whites was one of the causes of slavery. At the time when Mark twain was grown up, White men were born with privilege and superiority whereas blacks were doomed to be slaves. In The Adventures of Huckleberry Finn, Papa says to Huck: ââ¬Å"You're educated; too, they say; can read and write.You think you're betterââ¬â¢n your father, now, donââ¬â¢t you, because he canââ¬â¢t? Iââ¬â¢ll take it out of youâ⬠. When Papa finds out that Huck is being sent to school by Ms. Watson and edu cated, he is intimidated by the fact that his son, is being civilized and going to be a better person than he is. A sense of insecurity is developed and Papa immediately sees Huck as a threat to his inherited privileges. This insecurity symbolized the whitesââ¬â¢ fear of losing dominance over black people.In Papaââ¬â¢s mind, Huck is his property; it is a bit strange for us to think that someone is actually ââ¬Å"ownedâ⬠by someone else, but at a time when slavery is tolerated publicly and has been practiced for hundreds of year, it is quite normal for people to dismiss the idea of individuality and personal freedom. The act of taking money away from Huck to buy drinks just because Huck is his ââ¬Å"propertyâ⬠implicates the southern tradition of whites forcing slaves to work on cotton fields in order to make money.Also, Papa saves his pride by kidnapping Huck from Ms. Watson without considering Huckââ¬â¢s willingness of doing so symbolized the privilege of white s dominating blacks in the old times. Hypocrisy plays another major role in the book. Mark Twain presents the hypocrisy of Southern society through the feuds between the Shepredsons and Grangerford. Huck observes that ââ¬Å"He hadn't seen no house out in the country before that had so much styleâ⬠when he first comes to the family.The fancy house where the Grangerfolds live shows the notations of aristocracy, in this house ââ¬Å"there are beautiful curtains on the windows, white with pictures painted of castles. â⬠The curtains painted with castles give the family a sense of superiority over other villagers. These minor details make them think that they are above everyone else. Along with the false aristocracy the Grangerfords also possess a false knowledge of academics. When Buck is asked to spell Huckââ¬â¢s name, the boy spells ââ¬Å"GeorgeJaxonâ⬠instead of ââ¬Å"Jacksonâ⬠, he misspells it.Buck mentions earlier that he went to school but he is not as ed ucated as he though he is. It is pretentious for the family to consider themselves as highly educated upper classmen when their son canââ¬â¢t spell correctly. Besides being pretentious and falsely aristocratic, the Grangerfords also are very religious. On Sunday both families attend church. When Huck goes in with the family he notices that in both the feuding families, ââ¬Å"the men take their guns alongâ⬠to church and talk about how the sermon was ââ¬Å"all about brotherly loveâ⬠after church.They slaughter each other brutally for the rest of the day yet they think they are good and God loving. Morality is another important theme in the book, Twain wrote Huckââ¬â¢s character to illustrate the changing values of morality and ethics in society. Huck is a round character, he starts out an innocent child who expects nothing from life but freedom, then gradually grows up and learns to follow his own morals and values over what societies deemed to be acceptable. For ex ample, in Charpter 31, Huck says: ââ¬Å"All right then, Iââ¬â¢ll go to hell! He decides to save Jim out of slavery against all odds. Although Huck was tempted to write a letter to Ms. Watson, informing her of Jimââ¬â¢s location, he follows his own moral value and decides to save Jim. This act shows that Huck has developed the maturity to accept consequences such as going to hell for his willingness to save Jim in order to follow his own value and satisfy his own moral standard. Early in the novel, Huck feels guilty of aiding a runaway slave escape from the good Christian women, but his racial discrimination against Jim lessens as the novel progresses.Their relationship reflects the conflict between the racist environment that Huck grows up in and their needs for each other. Eventually the conflict resolves itself when Huck realized that ââ¬Å"Just because youââ¬â¢re taught that somethingââ¬â¢s right and everyone believes itââ¬â¢s right, it donââ¬â¢t make it right â⬠. This quote shows that racism has been infused into Huckââ¬â¢s life and Jimââ¬â¢s words show that even though he is uneducated like other slaves, he has the ability to overlook Huckââ¬â¢s racism. Twain brings out these ideas and thoughts with the force of a childââ¬â¢s moral compass elegantly.President Barack Obama said in his inaugural speech: ââ¬Å"we have always understood that when times change, so must we; that fidelity to our founding principles requires new responses to new challenges; that preserving our individual freedoms ultimately requires collective action. â⬠He points out the importance of finding our own moral and ethic principles so that we are capable of facing new challenges the society presents to us. In the Adventures of Huckleberry Berry Finn, Mark Twain points out the the same thing.Huck is in moral conflict with the values and moralities of the society in which he lives. He is deeply confused by what the society needs him to do and w hat he wants to do as an individual. Huck eventually makes a moral choice based on his own valuation of Jim's friendship with him, a moral choice leads that leads an direct opposition to the thins he used to be taught. What President Obama and Mark Twain are both proposing is that it is our unsatisfaction of own conditions drives us to question the received values of society, in which way, we get on the road of seeking our own values.We experience emotions that we never experienced before by fitting on other people's shoes, thus we learn how to sympathize. A new ways of rationalizing and moralizing is developed. Mark Twain used ââ¬Å"n-wordâ⬠in his book to satirize that South for it long history of slavery and to make people realize how harsh African Americans were treated back in the days. By providing an accurate glimpse in to our horrible past, it makes us retrospect and think about the meaning of fairness and equality. Mark Twain proposes in his Lecture Notes that ââ¬Å" a sound heart is a surer guide than an ill-trained conscienceâ⬠.He wants us to know how important it is for us to keep seeking and improving their understanding of fairness and justice. Like the way he describes the novel ââ¬Å" a book of mine where a sound heart and a deformed conscience come into collision and conscience suffers defeatâ⬠which is consistent with Obama's speech on freedom. ââ¬Å"We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness. Speaking in general, Mark Twain identifies the problem of society, and makes us think deeply about things such as individual freedom, personal value and moral principles. President Obama reinforces them, he advocates the importance of certain notation of fairness and equalities so that minorities won't be oppressed because of majorityââ¬â¢s decisions. Throughout the no vel, societyââ¬â¢s voice is heard through the voice of 13 years old boy Huck. The racist and hateful contempt that existed at the time is at many times present.It is vital for us to recognize that Twain disputes these ideas throughout the novel. Twain brings out into the open of the unfairness of the society and makes the readers to challenge the belief of social norms. By using satire, irony and sarcasm, Twain points out the stupidity of slavery and illustrates societyââ¬â¢s viewpoints of morality in contracts with Huckââ¬â¢s own way of identify morality through his adventures with Jim. These social justice issues about slavery, poverty, hypocrisy and morality are real and as a matter of fact, we are experiencing it every day in different degrees.Use the war in Iraq as an example of a religious hypocrisy, while President Bush is trying to convince the Arab world that his war is about liberation, most Arabs see it for what is really is; it is a grab of economic and natural resources, an attempt to avenge Bushââ¬â¢s fatherââ¬â¢s honor by executing Saddam and a declaration of USââ¬â¢s world dominating power. The Adventures of Huckleberry Finn presents the issues on social justices in a humors way, it is exciting to read as well as engaging people into deep thinking.

This Should Not of Happened to Peter Connelly
This should not of happened to Peter Connelly ââ¬â By Jonathan Pinder Born 1st March, 2006, Peter Connelly ââ¬Å"Baby Pâ⬠was only three months old when his natural father walked out after the mother; Tracey Connelly began an affair with Steven Barker, a racist thug obsessed with Nazi memorabilia and pornography. This was the start of the end for such a beautiful little innocent boy! In the world we live in today this should NEVER have happened!So many things should never have slipped through the net and gone un-noticed. The professionals where the only people that could of saved this poor little boyââ¬â¢s life, they had the words! They had the means! And they had the power to stop this. But instead Fifteen month-old ââ¬ËBaby P' was left to die at the hands of his mother and stepfather because of catastrophic blunders by doctors, police and the same Haringey Borough Council who so disastrously failed to help nine year-old Victoria Climbie ten years earlier.Rather than resign in shame, doctors and social workers have fallen over each other to blame others and keep their jobs. And so it begins! In November 2006, Tracey Connellyââ¬â¢s new boyfriend, Steven Barker, moved in with her and shortly after the new lover moved into the family home in Finsbury Park, north London, Peter was seen with bruises and scratches on his skin on a visit to his GP Dr Jerome Ikwueke. This is when the excuses and lies began; Tracey Connellyââ¬â¢s excuse was that the boy's skin ââ¬Ëbruised easily. But no sooner had Peter visited the Doctors, Peter was taken to Whittington hospital with a head injury, bruising to the bridge of the nose, sternum, right shoulder and buttocks and when Tracey was asked about finger-marks on Peters body, the mother said they were from ââ¬Ëholding him and throwing him up in the air. ââ¬Ë(Excuse and lie number 2) She also claimed that Peter, now only 9 months old, liked ââ¬Ërough and tumble playââ¬â¢ (Excuse and lie number 3 ) when she was under police questioning on suspicion of assault.This is where Haringey social services placed Peter on the ââ¬Ëat risk' register and visited the family home to find it filthy and smelling of urine. Is this acceptable for a baby Was this question asked Yes it was and they came to the conclusion to let Peter stay with Angela Godfrey, a church going therapist and Tracey Connelly's best friend, instead of a foster carer. Why a friend of the mother who has just been questioned on suspicion of assaulting Peter and whoââ¬â¢s house was so filthy? But within just a month, on January 26, 2007, with no decision made on any charge against the mother, Peter was allowed back home!Mistake 1 and the first of many! On April 9TH, Peter was taken to hospital with a large swelling to his head and bruises to his eyes and cheek. Despite the injuries ââ¬â which Tracey Connelly claimed were caused by another boy pushing him into a fireplace (Excuse and lie number 4) ââ¬â docto rs focused on treating the boy for possible symptoms of meningitis. While at hospital Tracey Connelly told staff ââ¬ËI had been told in March that if there were any more accidental injuries they were going to take him away. ââ¬Ë Was this Traceyââ¬â¢s way of asking for help? If so why wasnââ¬â¢t this followed up?Well it was and social services took no action other than to buy the family a fireguard. A fireguard Then on June 1st the social worker made an unannounced visit to the home and found Peter with bruises under the chin and a red line under his eye. Tracey Connelly claimed that another 18 month-old child had hit the boy during a squabble (Excuse and lie number 5). Tracey Connelly was ordered to take him to hospital. An examination by doctors revealed more bruising in 12 different areas of his body including a ââ¬Ëgrip mark' on his leg. Tracey Connelly was interviewed by police four days later but again released on bail for the second time.Disregarding the mountin g evidence, it was decided jointly by police and social services to allow Peter home on condition his care was supervised by Angela Godfrey. The police officer investigating both assaults, DC Angela Slade, did at first object to returning the child but it was decided there was not enough evidence to start care proceedings. Peter's condition deteriorated even faster he lost weight and his scalp and ear infections became so bad that the child-minder refused to look after him anymore and his GP only prescribed anti-bacterial cream.When Peter spent a night with his natural father; he had lost nails on his fingers and toes. On the next visit by social worker during a scheduled visit Tracey Connelly covered up Peter's bruises with chocolate (Excuse and lie number 6). Why was this happening and still no-one noticed anything and spoke up? Peters Last Chance The last chance to save Peter's life came on August 1st, when a doctor examined him at the Child Development Clinic in St Anne's Hospit al, Tottenham. The doctor failed to spot his fractured ribs and ignored a series of bruises to his back and legs. Peter may even have already been paralysed y having his back snapped over a hard surface such as an adult knee or cot. When in court the doctor later said ââ¬ËHe didn't look any different from any child with a common cold. ââ¬Ë The next day, August 2nd, 2007, Tracey Connelly was told the assault investigation against her was being dropped and offered a free trip to the seaside as a treat! Peter spent that evening face down in his cot, wrapped tightly in a blanket ââ¬Ëlike a cocoon' while his mother and stepfather celebrated. Peter was already dead when Tracey Connelly finally got out of bed at 11am. Good bye Peter. Why didnââ¬â¢t anyone fight for you?Peter was seen by 28 different social workers, doctors and police officers before he was tortured to death! Whoever is to be blamed, and however the degrees of blame are to be portioned out, the bottom line is th at Peter was killed after a horrific 18 month life, during all or most of which he was repeatedly beaten and physically injured by his mother, and her partner, and, perhaps, the lodger. What happened is beyond excusing or excuse-making. Those responsible should be called to account and removed from such work. Everyone from the case workers, to their supervisors, and the doctors and police.Too many people and too many mistakes. Why did everyone make some many failings? The ââ¬Å"devastatingâ⬠catalogue of failings on the part of Haringey Council, health advisors and police meant that those who highlighted fears were ignored and the obvious signs of abuse went unheeded. It took seven inspectors from Ofsted, the Healthcare Commission and Her Majesty's Inspectorate of Constabulary just two weeks to produce the report comprising a long list of failings. (See list of failings) But the biggest blow came from the reaction of us, the public who rarely see these types of events and such brutality.This cut us all to the core. To hear this brutality to such a young little boy was harrowing and devastating and then to hear of all the failings made by the people and authorities that where put in place to help prevent this was disgusting and we all wondered what exactly these people do for a living? For me as a support worker originally from a childrenââ¬â¢s background and now working with vulnerable adults this made me look more closely at my work and the procedures that where in place to see what changes I could possibly make and to be honest the changes arenââ¬â¢t at ground evel that need to be made, these changes need to come from way up the ladder, from managers up to the MPââ¬â¢s. So where do we go from here? What happened here was horrific but we must move forward. This should never have happened but unfortunately these things do happen and do slip through the net, the only positive thing that will come for this will be new rules and recommendations tha t are laid out for departments for Children, Schools, Residential childrenââ¬â¢s homes, other professionalââ¬â¢s and families.The joint area review has brought out a list of recommendations to enable all such parties to ensure that comprehensive and effective safeguarding arrangements for children and young people are established (see attached Recommendations of the joint area review) Also Ed Balls (Children's Secretary) told MPs that in the light of the Baby P case; ââ¬Å"We have tabled three new clauses that will help us to go further towards implementing Lord Lamingââ¬â¢s recommendations in this Bill, they will introduce new statutory targets for safeguarding and child protection and require local safeguarding children boards to appoint two members drawn from the local community and to publish an annual report on their effectiveness, But these measures could only go some way to protecting childrenâ⬠. And this is a sad and truthful fact that we will never be able to stop every single death of a child or vulnerable person, despite being known or unknown to social services.Itââ¬â¢s a sad point, but it is not realistic to say that every child murder can be prevented. Child protection is everyoneââ¬â¢s business, but things that go on behind closed doors stay there- even when they shouldnââ¬â¢t.! List of failings found by Ofsted, the Healthcare Commission and Her Majesty's Inspectorate of Constabulary Insufficient oversight of child protection services by Haringey's councillors and senior officers; *A managerial failure to ensure all the requirements of the inquiry into Victoria Climbie's murder in 2000 is met; *Social workers, health professionals and police do not communicate routinely and consistently; *A failure to identify children who are at immediate risk of harm; *Frontline procedures are of inconsistent quality; *Child protection plans are generally poor; *Record-keeping for case files is inconsistent and often poor; *An over-reliance on performance data which is not always accurate; * A failure to speak directly to children at risk; Concerns that youngsters suspected of being abused may not have been able to speak up without fear; *The Serious Case Review into Baby P's death is inadequate; *The high turnover of social workers at Haringey Council has resulted in heavy reliance on agency staff, leading to a lack of continuity for children and their families; * Heavy workloads for social workers, with the true number of children allocated to them not always accurately counted. The inspectors' summary to their report may have been written in official jargon but its stark meaning is clear enough. They wrote: ââ¬Å"The contribution of local services to improving outcomes for children and young people at risk or requiring safeguarding is inadequate and needs urgent and sustained attention. In other words, vulnerable children in Haringey cannot necessarily rely on the authorities to protect them and Baby P's death was not just tragic bad luck. Recommendations of the joint area review The joint area review made the following recommendations that the Department for Children, Schools and Families should provide immediate appropriate support and challenge to the local authority to ensure that comprehensive and effective safeguarding arrangements for children and young people are established. The Local Authority, working with its partners and in particular health and the police, should: *improve governance of safeguarding arrangements establish more secure assessment and earlier intervention strategies which ensure that, in all cases where concerns about c hildren are identified, agencies can intervene and assess risks of significant harm to children in a timely manner *establish more systematic monitoring of the quality of practice ensure that managers and staff at all levels are accountable for casework decisions, and that they draw as necessary on the expertise of partner agencies to inform the decision making process *take steps to integrate individual service processes and systems across all agencies more effectively *assure the competence of leadership and management in all areas of childrenââ¬â¢s services and develop clear and effective accountability structures *establish rigorous arrangements for management of performance across all agencies, which ensure that the quality of practice is evaluated and reported regularly and reliably, and that accountability for each action is defined and monitored *make explicit to all staff and elected members the expectations and standards required of front line child protection practice *establish rigorous procedures to audit and monitor the quality of case files across all partner agencies and ensure processes are in place to deliver improvement *establish clear procedures and protocols for communication and collaboration between social care, health and police services to support safeguarding of children, and ensure that these are adhered to *assure the competence of service and team managers in conducting rigorous and evaluative supervision and monitoring of safeguarding practice *appoint an independent chairperson to the local safeguarding children board (LSCB). Whilst not a mandatory requirement, it would be good practice for the Local Authority to: *ensure that all elected members have CRB checks *ensure that all elected members undertake safeguarding training.

The issue here is not merely the number of tests a student has to go through, but the test itself. However, increasing the number of tests in a year increases the issues in these tests as well. Even author Alfie Kohn in his book ââ¬Å"The Case against Standardized Testing: Raising the Scores, Ruining the Schoolsâ⬠explains his opposition to standardized testing. The issues surrounding the tests are abound, yet articles that give adequate information on the tests are lacking. Most of the publicly available articles offer generic information on the tests, but do not really describe the content. Sometimes, the content of the test might surprise the students and their parents (Harlen, 2002, p.141). When compared, the results of the two samples taken from South Platte and Cherry Creek came out relatively different. Both the samples had good quantities of dissolved Oxygen although their values differ due to the location of the samples taken from. Another important factor that stood in the results was the dangerous levels of nitrates found in certain areas of the river basin and shed making the water unsafe for use in those areas. Alkalinity was consistent in shed as well as the areas of river basin. Hardness also varied in different areas but it is of not much concern as hard water has been acclaimed fit for use due to the presence of minerals and nutrients in it which are rather healthy. Criminal Liability and GBH Problem Question From a brief review of the facts it seems that Aisling may be charged for criminal liability under non-fatal offences against the following; Charles, Bernadette Dan. However, Aisling must realize that the prosecution would have to prove each and every element of the beyond reasonable doubt, Woolmington v DPP[1]; which is a very high standard to achieve. S.39 of the Criminal Justice Act (CJA) 1988[2] defines common assault battery as summary offences, and consequently a person proven guilty of either is liable to a fine and/or imprisonment for not more than 6 months. The prosecution, will likely assert that Aislings words constituted an assault to Charles. For such a charge to carry any liability, the prosecution will have to prove that Aislings intentional words caused Charles to apprehend impending unlawful force. The House of Lords (HOL) made it clear in Ireland [3], that words can on their own constitute an assault; as per Lord Stern. Moreover, Aisling cannot take up the defense , that she did not intend to threat Charles, but rather just wanted Charles to leave; consequently, her act of saying the words is enough evidence for a charge of assault, Logdon v DPP [4]. However, in this case, the whole conviction rests on the fact that did the victim apprehend immediate unlawful personal violence? because if Charles did not feel threatened at any moment during his conversation with Aisling, then such a conviction may not stand against the defendant. The court cleared that in situations where an assault to person is not possible, words alone could not suffice to carry any liability; Tuberville v Savage [5]. This seems quite self-evident given the fact, that she intended to use those words so that Charles would leave the birthday party. As for Aislings criminal liability towards Bernadette; she may be charged on two accounts; firstly, the injury to the foot, sustained by Bernadette; Aisling may be charged under s.20 OAPA for maliciously wounding or inflicting GBH. For such a charge the prosecution must prove that the defendants actions or omissions, wounded the victim; and as per the decision in C (a minor) v. Eisenhower[8], wounding entails à ¢Ã¢â ¬Ã ¦ a break in the continuity of both layers of the skin. Both the dermis and epidermis must be broken. However, it is noteworthy to mention that generally, minor wounds are charged under s.47 OAPA, but considering the evidence that Bernadette lost a lot of blood and required ten stiches, it is fair to assume that this criminal charge will fall under s. 20 OAPA. As far as the Mens rea is concerned, the prosecution must establish that Aisling either intended or was reckless to the fact of causing the injury/ies. Lord Diplock in Mowatt[9] made clear the correct interp retation of maliciously; and later affirmed by the HOL in Savage Parmenter[10]; that it does not matter whether the accused foresaw that their unlawful act could not cause harm to such a gravity, i.e. serious harm. All that was essential was that the accused anticipated à ¢Ã¢â ¬Ã ¦some physical harm to some person, albeit of a minor characterà ¢Ã¢â ¬Ã ¦. And from the facts, it is palpable that Aisling noticed the broken glass and the danger it may cause to the guests who were about to play blindfolded, but neglected the danger which she created, anyways. Such recklessness is covered by the test laid down by Lord Diplock. And, in Caldwell[11] Lord Ackner affirmed that the prosecution must prove the defendants intention or foresight, of his actions causing harm. Aisling second charge will be for the punch, which although was meant for Dan but landed on Bernadette; s.47 OAPA Assault occasioning actual bodily harm (ABH) provides for imprisonment for a term not exceeding 5 years. The prosecution must firstly, establish that there was a common assault, both assault and battery; DPP v. Little[12]; and this assault or battery resulted in occasioning ABH to the victim. Here, Aisling tried to punch Dan, but he ducked and the punch was received by Bernadette, which is battery; the actual unlawful force towards the victim, without their consent, Fagan v MPC[13]. The prosecution must establish that there was an application of force; Collins v Wilcock[14]; Goff LJ stated à ¢Ã¢â ¬Ã ¦ that every persons body is inviolateà ¢Ã¢â ¬Ã ¦. Any touching of another person, however slight may amount to a battery. ABH is defined in Miller[15], as including any hurt or injury calculated to interfere with the health or comfort of the victim. The 1994 Charging Standards guidelines provides a scale to determine ABH [16]. Secondly, the persecution must establish causation; that the application of force, occasioned the bodily harmed suffered by the victim. The test to establish legal causation would require the prosecution to prove that Aislings actions; i.e. punching, was the operating substantial cause of the suffering to Bernadette; Pagett Cheshire[17]; which is evidenced by the fact of the eye bruising and discomfort which lasted for 3 days. However, it must be noted that Aislings defense cannot rely on the fact that Aisling never had the necessary mens rea of punching Bernadette, as the doctrine of transferred malice will come into play and effectively transfer the mens rea of the offence from Dan to Bernadette; Latimer[18] where the defendant was held liable for injuries to a third party bystander, when the accused tried to hit the original victim but missed had hit another third party bystander. Aisling intentionally hit Dan with a vase on the head, because of the remarks he passed on her; thereby causing head injuries which caused Dan to suffer a coma for several weeks. The prosecution will push for a conviction under s.18 OAPA GBH with intent. They will, first have to prove that Aisling inflicted or caused the injuries to Dan; Wilson[19], thus it must be proved that was the defendants actions were the operating substantial cause for the injuries sustained by the victim; Cheshire[20]. Secondly, the prosecution will have to establish that the harm suffered by Dan was really serious harm, as per the HOL in DPP v. Smith[21]. Thus, in Bollom [22], the COA held that the jury must consider the age, health and the entirety of the injuries; in deciding whether the injuries sustained were grievous or not. The 1994 Charging Standards provides guidelines to determine GBH in injuries [23]. Lastly, the prosecution must establish Aislings necessary mens rea and must prove that she inte nded to cause serious harm/ GBH to Dan. As it is factually evident that she hit the vase with full force, at Dans head, it is presumable that she must have foreseen some really serious harm coming to Dan. But for a conviction under s.18 OAPA, specific intent to cause grievous bodily harm or to resist arrest is required and recklessness or foresight is not sufficient. Similarly, in Ismail[24]; the court found the defendant liable for GBH with intent, where he threw acid on the victims face, thereby causing injuries and blinding. Ultimately, it will be up to the jury to decide the question of intention guided by these principles, finding Aislings criminal liability towards Dan. We must learn to speak as well and communication effectively even most of us are born with the physical ability to talk. There are various ways to understanding the verbal and nonverbal meanings thru our speaking, learning and ability skill. We learn the basic communication skill by observing other people and modeling our behaviors based on what we see. We also taught some communication skill through education, by practicing skill and having them evaluated. In simple terms, communication can be defined as an action. Communication not only in written form or oral, even a gentle touch or a knowing look can also communicate a message loud and clear, as can an angry slap or a hard push. Take an example: babies communicate basic wants through crying. It does not include language and dont have to be vocalized. It is just a simple transmit information from one person to another person. It must have a message that being transferred from sender to receiver in every instance of communication. The sender and receiver must have some words, signs o signals in common with each other to make sure for the communication to be success so that message can easy to deliver and understood. Communication is also a two-way interaction between to parties to transmit information and mutual understanding between themselves. The interchange of information from one party to another is best when a discussion available, it can makes the communication easier because the receiver can ask questions and receive answer to clarify the massage. 1.1 Communication Process The communication process is the guide toad realizing effective communication. Effective communication leads to understanding, it is also opportunities to become more productive if that follow the communication process. Sender and the receiver take place in the sharing through the communication process. Communication process is a set of steps that will undertaken in an organization while every time formal communication. It is helps to ensure that your stakeholders are kept regularly informed. The communication process is made by four key of components. Those components include encoding, channel, decoding, and feedback. Sender and the receiver are also the two other factors in the process. The communication process begins by the sender and ends with the receiver. Noise in the communication process is any kind of interruption which can disturb the communication. 1.1.1 Sender (encoder) Sender is the boss who release the message originated. The sender must stat to encoding in order to convey meaning. You also need to be confident in the information that you communicate is useful and accurate. A positive attitude of the communicators and the meaningful symbols select by the communicators are the factor that will determine how effective the communicator will be. 1.1.2 Encoding Encoding is the process that transferring the information you want, and correctly decoded at the other end with the form of communicated. For example, oral communication channel become more effective when immediate feedback is necessary, because it can be cleared up on the spot of an uncertainties. So that select the appropriate channel will greatly assist in the effectiveness of receivers understandings. 1.1.4 Decoding Decoding is performed in receiver side in the communication process. Decoding is once the message is received and examined, the stimulus is sent to the brain for interpreting, in order to assign some type of meaning to it. The receiver will correctly interprets the senders message is the communication takes place successful. 1.1.5 Receiver (decoder) Receiver is the person who simply receiving the message. Communication will only successful when the reaction of the receiver is that which the communicator intended. All the interpretation by the receiver is influenced by their knowledge, perception, attitudes, experiences, skill, and culture. It is actually similar to the senders relationship with recoding. 1.1.5 Feedback Feed back is the reply we receive to the message sent. It may a request for further clarification, a responses oral or written feedback, and undesirable decision or a detailed report. The sender cannot confirm whether the receiver has interpreted the message correctly or not without feedback. It also provides an opportunity for the sender to avoid the wrong action and to clarify a misunderstood message. 1.1.6 Noise Any things will interfere the understanding of communication also called as noise. Sentiments like this echo hauntingly through the pages of Alex Kotlowitz's account of his two-year documentation of the lives of two brothers, Lafeyette and Pharoah Rivers. The boys are afforded little happiness and too much grief, trying to survive from day to day in their appartment at the crime-ridden Henry Horner Homes housing project on the outskirts of Chicago. When Kotlowitz approached the boys' mother, LaJoe, about writing the book about her children, she agreed with him, but felt the need to set him straight. "But you know, there are no chlidren here. They've seen too much to be children," LaJoe told Kotlowitz. Lajoe moved to Horner when she was a young girl with her family of thirteen. The family had been living in a flat above a church that lacked adequate heating and frequently rang of organ music from the church below. Hearing of the newly finshed public housing projects for financially disadvantaged families, LaJoe's parents packed up the family and moved to one of the new buildings. When the family first arrived in their new home, they could not believe their eyes. It looked like a palace. Outside there were yellow flowers and lamp posts. The exterior of the building was made of sturdy, dark-red brick. Inside, the walls were a pristine white, with shiney linoleum floors. A new range and refrigerator awaited in the kitchen. It seemed like a dream to them -- until it all came crashing down. One of Lajoe's sisters was found strangled in the family's bathtub. Then, upon hearing the news of his sisters death, one of Lajoe's brothers had a heart attack and died. LaJoe's parents packed up soon ... ...sing the possibility of suing her husband for child support with someone. As for the analysis of the book itself, although the author aims toward providing a chronicle of two years in the lives of the two brothers, he actually ends up writing more about their mother. He depicts LaJoe as an extremely kind-hearted yet tough woman who will do anything to help not only her own family, but all the neighborhood children as well. LaJoe feeds and cares for many of the neighborhood children. For this, she is rare and special in an environment of black mothers who are prostitutes and drug addicts. She sticks by her children when most mothers would be ashamed and disown them. Literature (from Latin litteraetantri (plural); letter) is the art of written works, and is not bound to published sources (although, under circumstances unpublished sources can be exempt). Literally translated, the word literature means ââ¬Å"acquaintance with lettersâ⬠(as in the ââ¬Å"arts and lettersâ⬠). The two major classification of literature are poetry and prose. ââ¬Å"Literatureâ⬠is sometimes differentiated from popular and ephemeral classes of writing. Terms such as ââ¬Å"literary fictionâ⬠and ââ¬Å"literary meritâ⬠are used to distinguish individual works as art-literature rather than vernacular writing, and some critics exclude works from being ââ¬Å"literaryâ⬠, for example, on grounds of weak or faulty style, use of slang, poor characterization and shallow or contrived construction. Others exclude all genres such as romance, crime and mystery, science fiction, horror and fantasy. Pop lyrics, which are not technically a written medium at all, have also been drawn into this controversy. POETRY A poem is a composition written in verse (although verse has been equally used for epic and dramatic fiction). Poems rely heavily on imagery, precise word choice, and metaphor; they may take the form of measures consisting of patterns of stresses (metric feet) or of patterns of different-length syllables (as in classical prosody); and they may or may not utilize rhyme. Relaxation Through Poetry is a tool used to help someone relax in times of stress. One cannot readily characterize poetry precisely. Typically though, poetry as a form of literature makes some significant use of the formal properties of the words it uses ââ¬â the properties of the written or spoken form of the words, independent of their meaning. Meter depends on syllables and on rhythms of speech; rhyme and alliteration depend on the sounds of words. Arguably, poetry pre-dates other forms of literature. Early examples include the Sumerian Epic of Gilgamesh (dated from around 2700 B. C. ), parts of the Bible, the surviving works of Homer (the Iliad and the Odyssey), and the Indian epics Ramayana and Mahabharata. In cultures based primarily on oral traditions the formal characteristics of poetry often have a mnemonic function, and important texts: legal, genealogical or moral, for example, may appear first in verse form. Some poetry uses specific forms. Examples include the haiku, the limerick, and the sonnet. A traditional haiku written in Japanese relate to nature, contain seventeen onji (syllables), distributed over three lines in groups of five, seven, and five, and should also have a kigo, a specific word indicating a season. A limerick has five lines, with a rhyme scheme of AABBA, and line lengths of 3,3,2,2,3 stressed syllables. It traditionally has a less reverent attitude towards nature. Poetry not adhering to a formal poetic structure is called ââ¬Å"free verseâ⬠Language and tradition dictate some poetic norms: Persian poetry always rhymes, Greek poetry rarely rhymes, Italian or French poetry often does, English and German poetry can go either way. Perhaps the most paradigmatic style of English poetry, blank verse, as exemplified in works by Shakespeare and Milton, consists of unrhymed iambic pentameters. Some languages prefer longer lines; some shorter ones. Some of these conventions result from the ease of fitting a specific languageââ¬â¢s vocabulary and grammar into certain structures, rather than into others; for example, some languages contain more rhyming words than others, or typically have longer words. Other structural conventions come about as the result of historical accidents, where many speakers of a language associate good poetry with a verse form preferred by a particular skilled or popular poet. Works for theatre (see below) traditionally took verse form. This has now become rare outside opera and musicals, although many would argue that the language of drama remains intrinsically poetic. In recent years, digital poetry has arisen that takes advantage of the artistic, publishing, and synthetic qualities of digital media. This freedom also allows an author to experiment with many different literary and presentation stylesââ¬âincluding poetryââ¬âin the scope of a single novel. Other prose literature Philosophical, historical, journalistic, legal and scientific writings are traditionally ranked as literature. They offer some of the oldest prose writings in existence; novels and prose stories earned the names ââ¬Å"fictionâ⬠to distinguish them from factual writing or nonfiction, which writers historically have crafted in prose. Natural science As advances and specialization have made new scientific research inaccessible to most audiences, the ââ¬Å"literaryâ⬠nature of science writing has become less pronounced over the last two centuries. Now, science appears mostly in journals. Scientific works of Aristotle, Copernicus, and Newton still possess great value, but since the science in them has largely become outdated, they no longer serve for scientific instruction. Yet, they remain too technical to sit well in most programmes of literary study. Outside of ââ¬Å"history of scienceâ⬠programmes, students rarely read such works. Philosophy Philosophy, too, has become an increasingly academic discipline. More of its practitioners lament this situation than occurs with the sciences; nonetheless most new philosophical work appears in academic journals. Major philosophers through historyââ¬âPlato, Aristotle, Augustine, Descartes, Kierkegaard, Nietzscheââ¬âhave become as canonical as any writers. Some recent philosophy works are argued to merit the title ââ¬Å"literatureâ⬠, such as some of the works by Simon Blackburn; but much of it does not, and some areas, such as logic, have become extremely technical to a degree similar to that of mathematics. History A great deal of historical writing ranks as literature, particularly the genre known as creative nonfiction. So can a great deal of journalism, such as literary journalism. However these areas have become extremely large, and often have a primarily utilitarian purpose: to record data or convey immediate information. As a result the writing in these fields often lacks a literary quality, although it often and in its better moments has that quality. Major ââ¬Å"literaryâ⬠historians include Herodotus, Thucydides and Procopius, all of whom count as canonical literary figures. Law Law offers a less clear case. Some writings of Plato and Aristotle, or even the early parts of the Bible, might count as legal literature. The law tables of Hammurabi of Babylon might count. Roman civil law as codified in the Corpus Juris Civilis during the reign of Justinian I of the Byzantine Empire has a reputation as significant literature. The founding documents of many countries, including Constitutions and Law Codes, can count as literature; however, most legal writings rarely exhibit much literary merit, as they tend to be rather garrulous. Drama A play or drama offers another classical literary form that has continued to evolve over the years. It generally comprises chiefly dialogue between characters, and usually aims at dramatic / theatrical performance (see theatre) rather than at reading. During the 18th and 19th centuries, opera developed as a combination of poetry, drama, and music. Nearly all drama took verse form until comparatively recently. Shakespeare could be considered drama. Romeo and Juliet, for example, is a classic romantic drama generally accepted as literature. Greek drama exemplifies the earliest form of drama of which we have substantial knowledge. Tragedy, as a dramatic genre, developed as a performance associated with religious and civic festivals, typically enacting or developing upon well-known historical or mythological themes. Tragedies generally presented very serious themes. With the advent of newer technologies, scripts written for non-stage media have been added to this form. War of the Worlds (radio) in 1938 saw the advent of literature written for radio broadcast, and many works of Drama have been adapted for film or television. Conversely, television, film, and radio literature have been adapted to printed or electronic media. Oral literature The term oral literature refers not to written, but to oral traditions, which includes different types of epic, poetry and drama, folktales, ballads. However the use of this oxymoron is controversial and not generally accepted by the scientific community. Some prefer to avoid the etymological question using ââ¬Å"oral narrative traditionâ⬠, ââ¬Å"oral sacred traditionâ⬠, ââ¬Å"oral poetryâ⬠or directly using epics or poetry (terms that no necessarily imply writing), others prefer to create neologisms as orature.

Personality Assessment Essay
Personality is the set of emotional qualities and ways of behaving that makes a person different from other people, (Merriam-Webster, 2014). My personality is something that I have had since birth. It defines who I am and how others view me. Some people have outgoing personalities while others prefer to stay home or in other quiet places. I have always been a person that enjoys seclusion. After taking the Jung Typology Test, I now understand my personality. This test has helped me to define my strengths as well as my weaknesses which will help me in my academic career. My personality type is INTJ. I am 78% introvert, 25% intuitive, 12% thinking, and 56% judging, (www.humanmetrics.com, 2011). I found the test to be accurate and agreed with the results. Introverts are perfectionists that have a high level of confidence. Most introverts are logical thinkers that open their minds to all possibilities. ââ¬Å"INTJs are ideal people. They think anything is possible and everything is negotiable, (www.humanmetrics.com, 2011). I possess this introvert quality. I believe that there are always exceptions to rules. As a student, the introvert trait can be very useful to me. I like to be isolated from noise, so this can be helpful for reading course materials and studying. I can use my introvertââ¬â¢s problem solving skills to work through difficult tasks. Being an introvert also allows me to use my vivid imagination. This can be helpful when writing papers and doing projects. ââ¬Å"Students are expected to work in groups in traditional classrooms and the o nes that prefer to work alone are considered outliners or a problem, (Cain, 2012). As an online student my introvert trait will allow me to focus on my studies because I can work alone in my comfort zone. In addition to being an introvert, the test revealed that the next highest trait I possess is judging. Judging can be very beneficial to my academic success. This trait will allow me to make good decisions and keep me organized. ââ¬Å"INTJs are perfectionists with a seemingly endless capacity for improving upon anything that takes there interests, (www.humanetrics.com, 2011). Being a perfectionist will help me as a student. Perfectionism will help me complete assignments that contain quality information. My third highest trait is being intuitive. Being intuitive can be challenging for me as a student. Most people that have the intuitive trait hate the normal day to day routine. I am one of those people. I like to be challenged in new ways on a regular basis. Because I am attending school online, this will allow me to be flexible with my schedule and change things up a little. Overall, I agreed with the results from the Jung Typology Test. It gave me an explanation of why I do the things that I do. My introvert trait allows me to be in touch with my thoughts and feelings and this helps me to explore with my imagination. My judging trait helps me make logical decisions.
